Redfield, Ch. J.
The only question reserved in the case is in regard to the sufficiency of the fourth plea, being the third special plea in bar. And the first point made relates to the sufficiency of the vote of the district, “ that a tax should be raised to pay the expenses of the repairs of their school house.” It is argued that the amount to be raised, or the rate per cent of the tax, should be limited in the vote.
