BLATCHFORD, District Judge.

This suit was originally instituted in the supreme court of the state of New York, by the plaintiff, Fisk, against the Union Pacific Railroad Company, a corporation organized under a law of the United States, and not a banking corporation, «tnd twenty-three other defendants. It is alleged that four other defendants have since been brought in, by proceedings in the state court. The motion now made is founded on the idea that the suit is one now pending in this court, in which the plaintiff who commenced the suit in the state court is plaintiff, and all the defendants…
