At a former day of the present term of this court, the judgment of the trial court in this case was affirmed. We stated in a brief opinion at .that time that we affirmed the judgment because no fundamental error was apparent upon the face of the record, and because counsel for appellants had not at that time filed a brief for appellants, and, therefore, no reversible error was pointed out. In due time after we entered the order of affirmance, counsel for appellants filed in this court a motion for a rehearing and praying this court to set aside its order of affirmance and to reset the case…
