hFACTS AND PROCEDURAL HISTORY

Billy Carrier (Carrier) was injured in a work related accident in February 2006 during his employment with the City of Eunice, Louisiana. The City paid benefits initially, but disputes between the parties *1275arose in 2008. On September 13, 2010, Carrier’s action against the City was heard before the Honorable Judge Sam Lowery. Tiffany Harrington (Harrington), the vocational rehabilitation counselor assigned to Carrier, was called as a witness in the proceeding before Judge Lowery.
