OPINION

This cause comes into this court upon appeal from the Court of Common Pleas of Franklin County, Ohio, on questions of law and involves question of whether or not the court below erred in refusing to giant a new trial to the plaintiff below where, *114by consideration of a jury, she recovered a judgment against the defendant.
