This suit was filed by the city of San Antonio, for the use and benefit of Western Paving Company, which company afterwards intervened in its own right, against Mrs. Mary Elmendorf and her three adult children, Stella, Armin, and Edward Elmendorf, on a paying certificate issued by said city to said company on April 12, 1916, by virtue of an assessment ordinance alleged to have been passed on March 1, 1915. The amount sued for was $2,330.37, principal, with 8 per cent, interest, and reasonable attorney’s fees, alleged to be $1,000, and for foreclosure of assessment lien on certain premises…
