Berry, J.
The first count of the indictment in this case charges the defendants with an assault upon Bernard Clark with intent to murder, and the second count with an assault upon the same person with intent to commit manslaughter. ■
A separate trial being alloived, the appéllant David *37Dee was found guilty of an assault and battery, and sentenced to pay a fine of four hundred dollars. The .testimony as to the facts and circumstances of the alleged assault was conflicting and contradictory.
