OPINION
{¶ 1} Stewart W. Lawson was convicted of misconduct at an emergency after a jury trial in the Montgomery County Area One Court. Lawson was sentenced to serve thirty days in jail and to pay a $250 fine, plus court costs, with all of the jail time and $200 suspended on the conditions that he have no violations of the law for one year and he receive treatment at DayMont. The trial court stayed the sentence pending appeal. On appeal, Lawson claims that the trial court erred in failing to instruct the jury on the defenses of duress and necessity.
