It has been decided by this court that a judgment for attorney’s fees, founded upon a suit on a note or deed containing an *130obligation to pay attorney’s fees in addition to the stipulated rate of interest, is void where the record shows that the defendant did not appear or plead, and that the instrument sued on was executed before the passage of the act of 1900, which amended section 3667 of the Civil Code.
