This is an appeal from the action of the court below refusing an issue devisavit vel non and dismissing the appeal from the probate of the will of Mrs. India Mohler, a widow, who died November 28, 1939. The petition for a citation alleged that Mrs. Mohler when she made the will in question “was not of sound disposing mind, memory and understanding, but on the contrary was of unsound mind and incompetent to execute any paper requiring the exercise of discretion, mind, memory or understanding and that the execution was procured by contrivance and undue influence of…
