Pending before the Court is Plaintiffs Motion for Attorney’s Fees (Docket No. 15), dated December 7, 2010. Plaintiff requests fees in the amount of $1,780.27 pursuant to the Equal Access to Justice Act (“EAJA”), 28 U.S.C.A. § 2412. The EAJA mandates that this Court award attorney’s fees to a prevailing party in suit against an agency of the United States “unless the court finds that the position of the United States was substantially justified or that special circumstances make an award unjust.” 28 U.S.C.A. § 2412.
