In this diversity action, Twombly Associates, Inc.', a Massachusetts corporation, entered into a contract with the defendant Town of Watertown and its agent, defendant Perkins, chairman of the Watertown School Building Committee, for the furnishing and installation of certain science laboratory furniture and' equipment in the Watertown High School.
