I respectfully dissent for all the reasons set forth in my dissenting opinion in Chambers v. United States, ante, at 186, 451 F. 2d 1045. My reasons for dissenting in that case are fully applicable to this case, and they will be summarized below.

In this case, the plaintiffs relied mainly upon the Back Pay Act of 1966 (5 U.S.C. § 5596 (1964)), for recovery and secondarily upon Executive Orders 11246, 30 Fed. Reg. 12319 (1965), now EO 11478, 34 Fed. Reg. 12985 (1969) and departmental regulations. The executive orders and regulations are the same as those that were involved in the Chambers case.
