Appeal by the defendant from a judgment of the Supreme Court, Queens County (Linakis, J.), rendered November 9, 1983, convicting him of assault in the first degree, attempted robbery in the first degree (two counts), and attempted robbery in the second degree, after a nonjury trial, and imposing sentence. The appeal brings up for review the denial (Agresta, J.), of that branch of the defendant’s omnibus motion which was to dismiss the indictment.

Ordered that the judgment is affirmed.
