This case is now before the Court on the defendant’s motion [to set aside the verdict], renewed following the hung jury pursuant to Rule 1:11. The defendant argues that there is no conflict in the evidence which shows as a matter of law that the defendant’s decedent immediately before the accident, was suddenly stricken by a blackout spell which she had no reason to anticipate and that such condition caused the collision and the resulting damages to the plaintiff.
