BY THE COURT:

This is an appeal upon questions of law from a judgment of the Common Pleas Court of Allen county, Ohio, in an action pending therein wherein the appellee Mozelle Thompson, administratrix of the estate of Eugene M. Thompson, was plaintiff, and the appellee Anna Kerr was defendant.

The action is one for wrongful death of plaintiff’s decedent. It was tried to the court and a jury, and was. submitted upon the amended petition of the plaintiff, the answer and cross-petition of the defendant, the answer of the plaintiff thereto, the reply of the defendant to the answer to the…
