RAMSEY, Judge.

The conviction from which this appeal results was secured in the District Court of Limestone County on the 17th day of July of last year. The judgment carried a conviction of murder in the second degree, in which appellant’s punishment was assessed at confinement in the penitentiary for a period of twenty years.

The indictment filed June 26, 1909, contained three counts. The first count alleged that appellant with malice aforethought did unlawfully kill Woody Clancy by shooting him with a pistol. The other counts were dismissed by the district attorney, and the case submitted to…
