In 1850, the Legislature incorporated the Manufacturers’ Bank of Macon. For the purpose of establishing the bank, and carrying into effect the Act of incorporation, Washington Poe, John L. Jones, James Ray, Thaddeus G. Holt and Charles Day, were appointed commissioners. It is farther stated in the Act, *175that they are appointed commissioners, for the purpose of receiving subscriptions to the capital stock of the company.
