This matter is before the court on plaintiff’s claim for additional benefits and reasonable counsel fees in an action brought under the Pennsylvania No-fault *596Motor Vehicle Insurance Act, 40 P.S. §1009.101 et seq. The matter was heard without a jury on November 9, 1983, and the parties given leave to file memoranda of law with the court. Upon careful review of the memoranda and the record before us, we find the following facts to be undisputed.
