This libel was filed in personam by the appellee, seeking to recover damages for breach of contract which resulted in injury to the scow Geraldine on August 17, 1916. The appellant was engaged in the construction of a subway under Flat-bush avenue in the borough of Brooklyn, New York City. On May *80028, 1914, it executed a contract with the appellee., whereby the appellee agreed to providé scows and dumpers and receive excavated material at appellant’s slip on Gowanus Canal, near Ninth street, in the borough of Brooklyn, city of New York.
