LESLIE, Chief Justice.

Maude F. Butler, a feme sole, filed this suit against Robert McGarraugh, to recover $250 paid by her to the latter on May 26, 1928, as first payment on a residence in San Antonio, Tex. Although the deal was never consummated, the plaintiff obtained possession of the property while the title was being examined. Plaintiff and her then husband occupied the residence about four and a half months.
