Van Syckel, J.,

(dissenting.) Section 113 of the act respecting criminal procedure, provides that “ no person shall be prosecuted, tried or punished for any offence not punishable with death, unless the indictment shall be' found within two years from the time of the committing of the offence or incurring of the fine or forfeiture aforesaid.”
