The issue here is whether the State Highway Department of Georgia, rather than a municipality, has the power to place and operate traffic control devices on State highways within the limits of the municipality.

This issue arose when the State Highway Department filed in the Superior Court of Meriwether County an action against the Mayor & Council of the City of Woodbury. The complaint, insofar as necessary to recite, made the allegations hereinafter set out.
