' This matter is before us on a writ of certiorari to the Court of Appeal for the Parish of Orleans.

The plaintiff instituted an action ex delicto against the New Orleans Public Service, Inc., and Firmin E. Pomes, in solido, for damages for alleged personal injuries claimed to have been sustained while he was a passenger on a bus of the defendant carrier on June 29, 1937, at 6:20 a. m., when it is said that a collision occurred on the Jefferson Highway near Betz Avenue, Metairie, Jefferson Parish, La., as a result of the joint and concurrent negligence of the drivers of the…
