This prosecution was commenced on September 6, 1940, by an indictment filed in the circuit court of the City of St. Louis, Missouri. The defendant filed a motion to quash, which the trial court sustained. The prosecuting attorney then filed an information in lieu of the indictment which procedure is authorized by section 3953, Mo. Rev. St. Ann., Rev. St. Mo. (1939). The defendant filed a motion to quash the substitute information and while that motion was pending the prosecuting attorney, with leave of court, filed an amended substitute information.
