This case is before this court on the fol-' lowing agreed statement of the pleadings and facts:

“Plaintiffs brought this suit to get judgment "against Taylor McRae as the maker of a vendor’s lien note for $900, and to foreclose the lien on the land described in the decree as to all the defendants. It is agreed that on September 18, 1894, D. M. Poor conveyed to Taylor McRae said land, and received two vendor’s lien notes thereon for the sum of $900 each; first due in two years, or on September 18, 1896, second due in three years, or on September 18, 1897.
