— Affirming.. Richard, H. Ratliff of Shelbiana, Pike county, Ky., died testate in 1928, leaving surviving him Orpha Ratliff, his widow, Rebecca Morris and Mattie Fiddler, his daughters, and W. E. Yost, a grandson and only child of Polly Yost, a predeceased daughter.

By the provisions of this will, testator devised all of his estate “of every kind and character,” absolutely in fee simple as follows:

“First: One fourth (%) to my beloved wife, Orpha Batliff.
“Second: One fourth (%) to my beloved daughter, Martha Fiddler.
