This was an action of indebitatus assumpsit brought by Joseph Bowman, administrator of Thomas Newman, deceased. The declaration contains' two counts. The first is for work and labour, goods sold and delivered, and money paid, by the intestate, and for money had and received to the use of the intestate; promise to the intestate.
