The Eastern Paving Company entered into a written contract with the department of highways to construct a road in Luzerne County. To prevent misunderstanding in carrying out the plans and specifications, the engineer in charge was granted the right to decide all questions that might arise as to the quality and acceptability of materials furnished and the work performed, and also any disputes as to the proper fulfillment of the contract.
