This is an appeal by plaintiff, Michael Kern, from an adverse judgment in a suit for the recovery of wages allegedly due him, upon his May 12, 1995 resignation from employment with defendant, River City Ford, Inc. Plaintiff asserted his entitlement to unpaid wages pursuant to LSA-*980R.S. 23:631 and penalty wages and attorney’s fees pursuant to LSA-R.S. 23:632. The trial court granted defendant’s motion for involuntary dismissal on the issues of penalty wages and attorney’s fees and further rendered judgment dismissing plaintiffs claim for unpaid wages at the conclusion of trial.…
