FINDINGS OF FACT AND CONCLUSIONS OF LAW

1. The Court has jurisdiction of this matter pursuant to 15 U.S.C. §§ 1121 and 1128 and pursuant to 38 U.S.C. §§ 1331, 1337,1338, 2201 and 2202.
2. Venue is proper in this district pursuant to 28 U.S.C. § 1391(b).
3.
