Defendant was convicted, following a jury trial, of possession with intent to deliver less than five kilograms of marijuana, MCL 333.7401(2)(d)(iii). He was prosecuted as a repeat drug offender under MCL 333.7413(2), which provides for sentence enhancement when a defendant has been convicted of a second or subsequent drug offense under the controlled substances act, MCL 333.7101 et seq. The judgment of sentence reflects that defendant was sentenced to a term of 38 to 96 months’ imprisonment.
