This is an action of ejectment to recover possession of premises 4412 Sherwood Road, Philadelphia, Pa. Plaintiff filed *481his declaration in ejectment and abstract of title wherein it is set forth that sometime prior to June 1931 plaintiff employed defendant in the capacity of a chauffeur and entered into an oral agreement whereby defendant was permitted to occupy premises 4412 Sherwood Road during his employment.
