ALFORD, Judge.

Before the Court is Frederick S. Frei-bott’s (“Freibott”) appeal from a decision of the Court of Common Pleas granting Patterson Schwartz and Associates, Inc.’s (“PSA”) motion to dismiss. For the reasons below, the decision of the Court of Common Pleas is REVERSED and the case REMANDED for further proceedings.

BACKGROUND
