This appeal comes to this court on questions of law from a judgment entered for the defendant after a partial trial in the Municipal Court of Garfield Heights. The first cause of action alleges that the plaintiff purchased certain property located at 7191 Greenleaf Avenue in the City of Parma. In 1955 Greenleaf Avenue was paved and the cost of such improvement was charged to abutting property owners in proportion to the benefits.
