MEMORANDUM

KEARNEY, DISTRICT JUDGE

When responding to a citizen’s call for emergency medical help, a police officer must not violate a citizen’s Fourth Amendment rights to be free from unlawful seizure or subject to excessive force. When the citizen later sues the officer for unlawful seizure and excessive force in responding to the 9-1-1 call, we evaluate the adduced facts in deciding whether to apply a community caretaking doctrine exception to permit the officer’s warrantless seizure of the distressed citizen. We must separately evaluate whether the officer is entitled to qualified immunity.…
