NETERER, District Judge.
Libelant’s tug Mountaineer, of 55 tons gross, proceeding from the Improvement Company’s dock at Everett, crossed Everett Harbor to Priest Point, on October 16, 1911, and came *982into collision with the schooner Wilbert E. Smith, laden with a cargo of 900,000 feet of lumber, anchored west of the Great Northern dock, upon gtpiiad forbidden by city ordinance of the .city of Everett.
