Quinlan & Robertson, Incorporated, the plaintiff in this case, issued a writ of replevin against Rundle & Behm to recover a steam shovel; Ernest B. Posey, being given leave to intervene and defend, entered a counter-bond, retained the shovel and pleaded his ownership; judgment by default was entered against Rundle & Behm, but on the trial of the issue between plaintiff and Posey the latter obtained a verdict, judgment was entered thereon and plaintiff appeals.
