This is an action for alleged infringement of a copyrighted, unpublished song. Infringement is charged both as to lyrics and with respect to the music.

The evidence establishes without contradiction that plaintiff has composed approximately fifty to seventy-five songs, many of which she submitted to publishers, but none was published. Her musical education consisted of studying singing while .a university student and subsequently under an instructor.
