OPINION

ANNE GARDNER, Justice.

I. Introduction

Appellant Rodney D. Davidson appeals his conviction and ten-year sentence for felony driving while intoxicated (DWI). In two issues, Appellant complains that (1) the trial court erred in conducting a bench trial despite the fact that he did not waive his right to a jury trial, and (2) his trial attorney rendered ineffective assistance of counsel. 1 Because we sustain Appellant’s first issue, we reverse and remand this case for a new trial.
