I. Introduction
Creditor Sunset Partner, L.P. (“Sunset”) brings this motion for relief from automatic stay with respect to real property belonging to debtor Duncan & Forbes Development, Inc. (“D & F”). The court denies Sunset’s motion insofar as, based on § 362(d)(4), 1 it is grounded on a scheme to delay, hinder, and defraud Sunset through a transfer of the subject property without Sunset’s consent.
