I. Introduction
On April 6, 2001 Mahoney Hawkes, LLP (the “Debtor”) filed for relief under chapter 11. The Debtor was a law firm which had, in addition to other unsecured debt, outstanding malpractice claims. It carried a “Claims Made and Reported” legal malpractice insurance policy (the “Policy”) with Continental Casualty Company (“CNA”).
