Procedural History and Factual Background

This appeal concerns a dispute over a parcel of real property in downtown Raleigh. On 23 May 2011, Plaintiff New Bar Partnership (“New Bar”) filed a lis pendens in Wake County Superior Court providing notice of the existence of claims potentially affecting title to the property at issue.
