OPINION & ORDER

STEIN, District Judge.

Tyrone Mingo brings this petition, pro se, pursuant to 28 USC § 2255 to vacate, set aside or correct his sentence. On April 12, 2002, Mingo pled guilty to one count of conspiring to commit bank fraud, in violation of 18 U.S.C. § 371, and two substantive counts of bank fraud, in violation of 18 U.S.C. §§ 1344 and 2. On November 18, 2002, he was sentenced principally to 37 months of imprisonment and was ordered to make restitution to the victims of his scheme in the sum of $340,047.
