MEMORANDUM OPINION

HUDSON, District Judge.

Plaintiff Christopher Scott Emmett, a Virginia state inmate sentenced to death, brings this civil rights action under 42 U.S.C. § 1983. By order entered on April 16, 2007, by the Circuit Court for the City of Danville, Virginia, he is scheduled for execution on June 13, 2007.
