OPINION AND ORDER

KING, United States Magistrate Judge.

Plaintiff Michael Cobb brings this action under 42 U.S.C. § 1983, seeking monetary damages from defendant Donovan Kane, an officer of the Columbus Police Department [“CPD”]. 1 Plaintiff alleges that defendant Kane stopped plaintiff without legal justification and conducted an illegal pat-down search of him in violation of his rights under the Fourth Amendment.
