STATEMENT BY THE COURT.

This suit was instituted by appellee Gatz against George W. Neal, Commissioner of State Lands, in the circuit court of Pulaski County, seeking mandamus compelling the State Land Commissioner to execute a deed in appellee's behalf to lot 6, block 7, of the original town of Paragould, Arkansas.

It was alleged in the complaint that the lot was charged with taxes for the year 1929 for the aggregate sum of $399; that said taxes were not paid in 1930, and the State became the purchaser thereof on June 9, 1930; that the penalty which attached on the date of the sale was $39.90,…
