ANDREWS, J.,

This is an appeal from a judgment of the district court of Choctaw county in favor of the members of the county excise board of Choctaw county, who were the defendants in the trial court, against school district No. 33 of Choctaw colunty, the action being brought for the benefit of itself and other school districts in that county similarly situated, who was the plaintiff in the trial court.

In its petition the plaintiff prayed for a writ of mandamus requiring the defendants to convene as the excise board of Choctaw county and to levy 12.86 mills ad valorem tax against the property…
