Defendant was convicted in 1991 of committing a second degree aggravated assault upon Raymond Jimenez (“Jimenez”) on or about August 11, 1990, contrary to N.J.S.A. 2C:12-1b(1). He was sentenced on May 24,1991, to the custody of the Commissioner of the Department of Corrections for ten years, with five years to be served before parole eligibility, consecutive to a sentence defendant was then serving.
