—In an action, inter alia, for a judgment declaring that the plaintiff is the owner of certain real property by adverse possession, the plaintiff appeals from a judgment of the Supreme Court, Nassau County (Ain, J.), entered October 30, 1998, which, upon an order of the same court, entered October 2, 1997, granting the defendant’s motion pursuant to CPLR 4401, made at the close of the plaintiff’s case, for judgment as a matter of law, declared, in effect, that the defendant was the owner of the contested property, and dismissed the complaint.
